Welcome to Oztune NSW (“we,” “us,” or “our”). By using our ECU tuning services, you (“customer,” “you,” or “your”) agree to the following Terms of Service (“Terms”). These Terms govern your use of our website and services, including the ECU tuning of your vehicle.

Please read these Terms carefully before using our services. If you do not agree to these Terms, you should not use our services.

1. Services Provided

We offer ECU (Engine Control Unit) tuning services, which optimize the performance of your vehicle’s engine by modifying the software parameters within the ECU. These modifications are designed to increase power, fuel efficiency, and overall performance. However, it is important to understand that any changes made to the factory settings of your vehicle are done at your own risk.

2. Customer Acknowledgment and Responsibility

By using our ECU tuning services, you acknowledge and accept the following:

  • Customer Choice: The decision to tune your vehicle’s ECU is entirely at your discretion. You understand that tuning your car outside the manufacturer’s specifications may result in changes to vehicle performance, fuel consumption, and mechanical reliability.

  • Risk of Damage: You understand that pushing the engine beyond manufacturer specifications, as a result of tuning, can place additional stress on engine components and other mechanical systems. This can potentially lead to engine failure, reduced longevity, or other mechanical issues. We assume no responsibility for any damage, including engine failure, mechanical breakdowns, or other consequences, whether direct or indirect, that arise from tuning your vehicle.

  • Warranty Void: Modifying the ECU of your vehicle may void the manufacturer’s warranty. It is your responsibility to check with the manufacturer or dealership regarding any warranty implications before proceeding with our services.

  • Vehicle Condition: It is your responsibility to ensure that your vehicle is in good mechanical condition before undergoing ECU tuning. We do not guarantee the performance of the tune if the vehicle is not in proper working order.

3. Limitation of Liability

To the fullest extent permitted by law:

  • No Liability for Damage: We do not accept any liability for damage to your vehicle as a result of our ECU tuning services. This includes, but is not limited to, engine failure, transmission issues, or any other form of mechanical damage.

  • No Warranty on Tuning Performance: We do not provide any warranty, express or implied, that the tuning will perform without risk, will meet specific expectations, or that it will not result in damage to the vehicle.

4. Customer Representation

By proceeding with our services, you represent and warrant that:

  • You are the legal owner or authorized representative of the vehicle being tuned.

  • You have provided accurate information about your vehicle and its current mechanical condition.

  • You understand and accept all risks associated with ECU tuning and its potential consequences.

5. Refunds and Disputes

  • No Refunds: Once the ECU tuning process has started, there will be no refunds or cancellations. We strive to provide the best service, but tuning is a highly customized process, and once the work is completed, it cannot be undone.

  • Disputes: Any disputes arising from the use of our services will be resolved through binding arbitration under the laws of New South Wales, Australia, and not in a court of law.

6. Indemnity

You agree to indemnify, defend, and hold harmless Oztune NSW, its employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising out of or related to your use of our services, including but not limited to any damages or injuries resulting from modifications made to the ECU of your vehicle.

7. Modifications to These Terms

We reserve the right to modify, update, or change these Terms at any time. Any changes will be posted on our website, and your continued use of our services after such changes will constitute your acceptance of the updated Terms.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any legal action or proceeding related to these Terms must be brought exclusively in the courts located within New South Wales, Australia.
